Terms of Service

StickerSwap is a community platform that helps collectors find each other and discuss potential trades of physical sticker collectibles. We provide tools to manage your collection, identify users with complementary inventories, and exchange messages.

StickerSwap is a facilitator only. We are not a party to any trade. Specifically:

• We do not take custody of stickers, albums, or any physical items.
• We do not process, hold, or guarantee any payment between users.
• We do not verify the authenticity, condition, ownership, or quantity of any item listed.
• We do not ship, package, insure, or track any items exchanged between users.
• We do not mediate, arbitrate, or guarantee the outcome of any agreement reached between users.

All trades happen directly between users. Any agreement to swap, the method of delivery, the cost of delivery, the choice of carrier, the risk of loss, theft, damage, delay, or non-delivery, the authenticity and condition of items, taxes (if any), and any disputes that may arise are the sole responsibility of the users involved.

You acknowledge that we have no control over the conduct of other users and disclaim all liability in this respect to the maximum extent permitted by law.

You must be at least 18 years old to use the Service. By using StickerSwap, you represent and warrant that you are 18 or older and that you have the legal capacity to enter into these Terms in your jurisdiction. We do not knowingly allow accounts for minors. If we become aware that an account belongs to a minor, we will delete it.

You may not use the Service if you are located in, or are a national or resident of, any country or region subject to comprehensive sanctions imposed by the United Nations, the European Union, the United Kingdom, or the United States, or if you are listed on any sanctions or denied parties list.

You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You agree to provide accurate information and to keep it up to date. You may not impersonate another person, sell your account, or share access to your account.

We may suspend, restrict, or terminate your account at any time, with or without notice, if we believe you have violated these Terms, applicable law, or community guidelines, or if your conduct may harm other users or the Service.

You agree not to:

• Post content that is illegal, fraudulent, deceptive, defamatory, obscene, hateful, harassing, or that infringes any third party's rights.
• Offer for trade items that are counterfeit, stolen, illegal to possess or transfer, or that you do not have the right to dispose of.
• Use the Service to harass, threaten, scam, or otherwise harm other users.
• Solicit personal information from minors, or engage with minors through the Service.
• Use the Service for any commercial purpose other than the personal trading of collectibles between collectors.
• Attempt to circumvent security, scrape data at scale, reverse engineer, or interfere with the operation of the Service.
• Submit automated requests or use bots, except for publicly documented APIs within their published rate limits.
• Use the Service to send spam or unsolicited communications.

We may remove any content and take any action we consider appropriate at our sole discretion.

You retain ownership of the content you submit (photos of your collection, messages, profile information — "Your Content"). You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute Your Content solely for the purpose of operating, providing, and improving the Service. This license ends when you delete Your Content or your account, except (a) for content you have shared with other users, which they may retain, and (b) where retention is required by law or for legitimate operational purposes (backups, fraud prevention, legal claims) for a reasonable period.

You represent that you have all rights necessary to grant this license and that Your Content does not infringe any third party's rights.

StickerSwap is an independent community platform. We are not affiliated with, endorsed by, or sponsored by Panini, FIFA, UEFA, the IOC, or any sticker publisher, sports federation, or rights holder. References to album names, competitions, or publishers on the Service are descriptive and used solely to help users identify their collections.

If you believe content on the Service infringes your copyright or trademark, please contact us at legal@stickerswap.club with: (a) a description of the work, (b) the URL of the allegedly infringing content, (c) your contact information, (d) a statement of good-faith belief, and (e) a statement under penalty of perjury that you are authorized to act. We will review and respond promptly.

The Service is provided free of charge, "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, or uninterrupted availability. We do not warrant that the Service will be error-free, secure, or that any defects will be corrected.

To the maximum extent permitted by applicable law, we disclaim all such warranties. Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions, exclusions apply to the fullest extent permitted.

The Service is provided free of charge. To the maximum extent permitted by applicable law, our total aggregate liability arising out of or relating to these Terms or the Service, regardless of the cause of action (whether in contract, tort, statute, or otherwise), shall not exceed the greater of (a) the total amount you have paid us for the Service in the twelve months preceding the claim (which, for a free service, is zero) or (b) one hundred United States dollars (US$100).

We shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including without limitation loss of profits, loss of data, loss of collectibles, loss of goodwill, or any losses arising from trades, communications, or interactions between users.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability shall be limited to the smallest amount permitted by law. Nothing in these Terms limits liability that cannot be limited by applicable law (such as gross negligence, willful misconduct, or, where applicable, statutory consumer rights).

To the extent permitted by law, you agree to defend, indemnify, and hold harmless StickerSwap and its operators from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of (a) your use of the Service, (b) Your Content, (c) your violation of these Terms or applicable law, (d) your violation of any third party's rights, or (e) any trade or interaction with another user.

The Service is operated as a personal, non-commercial project. We may modify, suspend, or discontinue all or part of the Service at any time, with or without notice, and without liability to you. We will make reasonable efforts to notify users of material changes affecting their accounts and to allow data export before discontinuation.

We may update these Terms from time to time. When we do, we will revise the "Last updated" date and, for material changes, we will notify registered users by email or in-app notice and give a reasonable period to review. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not accept the updated Terms, you must stop using the Service and may delete your account.

These Terms are governed by the laws of Brazil, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of São Paulo, Brazil, except where mandatory consumer-protection laws of your country of residence grant you the right to bring proceedings before the courts of your domicile, in which case those rights are preserved.

For users in the European Union: nothing in these Terms affects your statutory consumer rights, including the right to bring proceedings in the country of your habitual residence under EU consumer-protection law. For users in the United Kingdom: nothing in these Terms affects your statutory consumer rights under UK law.

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect. These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and us regarding the Service and supersede any prior agreements.
